Safety-net for agents displaced due to RA 9646

QUESTION: Sir John, naiiyak na ako! Mawawalan na ako ng trabaho dahil sa RA 9646. Highschool graduate lang ako, 52 years old. Ang trabaho ko eh mag distribute ng real estate fliers, walang salary, pero may commission. Anong gagawin ko?

ANSWER: Find a licensed real estate broker and attach to him/her.

Because you don't meet the educational requirement, you will not qualify to become a registers Salesperson under the Licensed Broker. However, Brokers and even Salespersons normally hire non-Salespersons on salary basis to distribute fliers and do saturation. The R.A. 9646 does not require a license and registration to distribute fliers.

Just a piece of advice. Be sure that your name will not be the name stamped as contact person at the back of the fliers that you distribute, if you fail to follow this advice, you might go to jail. It is the name of the Broker or Salesperson who employ you that will appear at the back of the fliers. If you find a potential buyer, contact your employer (Salesperson or Broker) and have him/her talk and deal directly to the buyer.

So don't worry. You will still be earning in the real estate industry. Under the new set-up, you will no longer be included in the commission structure. This time you will become employed and you will be paid salary or wage with all the employee benefits.

Those sales people who are registered with the DTI/HLURB OR those who are and have been actively practicing for the last 3 years prior to the effectivity of RA 9646 may still be accredited by the PRB-RES until July 30, 2011. Provided they have completed 120 hours of training (not CPE units), with a notarized certificate from the supervising licensed broker, submission of original NSO birth cert, NBI clearance, and certificate of educational attainment or its equivalent. After July 30, 2011, you'll have to be at least 2nd year college before you can be eligible as a real estate salesperson.

The IRR of this PRB-RES is inconsistent with the RA 9646. Take note of the "and" between at least 2 yrs college "and" seminars. Inconsistency and anomalous accomodations is what happened after the IRR Consultation was adulterated.

SEC. 31 Supervision of Real Estate Salespersons

For real estate salespersons, no examination shall be given, but they shall be accredited by the Board: Provided, That they have completed at least two (2) years of college and have undergone training and seminars in real estate brokerage, as may be required by the Board.

I believe the IRR is not really inconsistent with the act, merely complementary, like a bridge. The provision for sales persons was added so as not to alienate those who have been in the practice for the last 3 years but are not at least 2nd year college level. I think it's very kind of them to have included this before the doors close permanently on July 30, 2011.

Yes indeed. In the humanitarian side I do believe they are kind and accommodating to find ways to exempt those who are run over by the fierceness of the law. But in the professional side, we call it tolerance to corruption. In my profession, trust and confidence is very vital in maintaining few power-clients, there is no room for a small anomaly.
