The RA 9646 Grandfather Provision

QUESTION: Sir John, ano po ba yung tinatawag na "grandfather provision" in RA 9646?

ANSWER: Yang grandfather provision ang mga automatic Charter Members ng AIPORESP. That is in Sec 20 of RA 9646, titled Registration Without Examination. Ang problema eh merong ginawa na "insertion" ang PRB-RES dyan para ma-accomodate yung mga DTI-licensed brokers na hindi "pasok" sa grandfather provision at ang resulta ay IRR na inconsistent sa original wordings ng RA 9646.

QUESTION: Sir John, pwede po ba merong PROXY voting sa election of AIPORESP Trustees and Officers?

ANSWER: Hindi pwede. Hindi ako makapapayag sa Proxy scheme na yan. Dapat informed decision-maker and participant voter ang bawat isang voter. There must be sufficient time for campaigning and candidiates must have same access to the voters list and contact information. Always remember, the Charter Members of AIPORESP are those who are covered by the grandfather law, all the rest are automatic members. Pag merong isa na ma-disenfranchised, I will not honor the election.

Pag sundin mo ang RA 9646, dapat nga ang PRC hindi mag issue ng license pag walang Official Receipt ang Broker. That's why in my operation as Exclusive Buyer Agent, I don't recognize PRC License Cards kasi contaminated ang Integrity nyan eh. Pag meron PRC License Card ang nag submit sa akin ng proposal at tinamad ako mag conduct ng background investigation eh regret ko na agad ang proposal. Pag unlicensed naman eh sigurado reject agad ang proposal. Directa na lang ako sa FSBO para maka-sigurado na malinis ang transaction.

And they will continue violating the laws with the backing of "your" so called close friends in CREBA, ASSOCIATIONS, and PRB-RES. That is why you have to define yourself, who you are, what you are, and join IPORESP because this is the only group that advocates strict implementation of RA 9646.
