Anti-Colorum Advocacy Message must be Extra Careful

QUESTION: Sir John, dapat magpakalat tayo ng advocacy message na kapag walang PRC License, iwasan nila kasi colorum yan! Ano sa tingin mo?


ANSWER: Watch out din sa SEC. 28 ng RA 9646. Exemptions from the Acts Constituting the Practice of Real Estate Service. Ang FSBO and SPA ay exempted mga yan. Pati mga banks na nagbebenta ng foreclosed properties. At marami pa dyan sa exemptions.

When I say watch out, ang Anti-Colorum Advocacy Message natin ay dapat walang negative-effect sa dealings ng mga exempted under Sec 28. Pag isisigaw mo ang signal sa market na "Pag walang PRC License eh Colorum na dapat iwasan", ehhh medyo mali yan, unfair yan sa mga exempted.

Niego: Sir John, confirmation lang….when you say exemption of FSBO, does this include people who are real estate investors who are engaged in the business of buy-and-sell, rehabilitation of property, etc.? However, what will happen if the investors/sellers use the service of a broker in selling of the property? Will he cease to be an FSBO? Will the seller violate Sec 28 already?

ANSWER: Malawak ang sakop ng FSBO (For Sale By Owner). Ang technical term ng mga tao na gumagawa ng buy-and-sell operation ay Real Estate Dealer. Pag Delar mismo nagbenta, sakop yan ng FSBO. Pag mag-utos na ang FSBO ng ibang tao para magbenta, kailangan yang ibang tao na yan ay merong PRC License, unless SPA ang agreement nila na walang naka-stipulate na Compensation.

FSBO is all about how the property is offered, advertised, and promoted to the market. Pag ang owner nag offer nyan, FSBO yan. Pag SPA nag offer nyan, FSBO yan. Pag Agent nag offer nyan, hindi yan FSBO at covered na yan ng RA 9646
