Brokers have exclusive power over salespesons


QUESTION: Sir John, bakit po kahit walang Broker endorsement ang Ahente ng developer eh pwede siya maka-register as Salesperson sa PRC?

ANSWER: It is because the PRB-RES who is sitting now DON'T KNOW HOW TO READ simple english of the RA 9646. In short GRAVE STUPIDITY. Broker lang ang pwede mag supervise, register, and terminate the services of a Salesperson. Salespersons cannot work for, under the direct supervision of Developers, Dealers, and FSBOs. Brokers have exclusive power to supervise/register Salespersons.

Section 31 Paragraph 2 of RESA Law says, "Real Estate salespersons shall be under the direct supervision and accountability of a real estate broker. As such, they cannot by themselves be signatories to a written agreement involving a real estate transaction unless the real estate broker who has direct supervision and accountability over them is also signatory thereto."

Now we have a real estate sector with developers having salespersons who have not finished second year college and are not supervised by licensed brokers. I call that SUBSTANDARDIZATION -- that's the effect of the CREBA-NAR Partnership -- SUBSTANDARDIZATION.

The buyer protection and advocacy response natin sa situation na eto ay simple. We should advice the buyers to AVOID Salespersons of Developers because MOST LIKELY, these are professionally "SUBSTANDARD" people. We should tell the market na kapag maka encounter sila ng ahente/salesperson ng Developer, palagi nilang dapat i-demand na "I would like to deal DERECTLY with the Owner of the Development Company or with a BROKER".
