CPE leading to Masters Degree

Real Estate practitioners who choose to specialize as teachers should qualify/work in CHED-accredited universities. The universities will provide CPE-services (whether on retainer basis, on-call, or regular basis) for the Realty Corporation. The training would contain subjects on leadership, sales techniques, and PROJECT FEATURES for a total of 60 hours (or whatever number of hours the PRC will impose as requirement for renewal of license). The training would be properly disseminated in universities and also in the Corporation's websites -- it is up to the licensed practitioners to decide where to take the training.

In general, the CPE should be FREE for licensed real estate practitioners. What the Realty Corporation will get in return is that the real estate practitioner will agree to carry (non-exclusive) the product line of the Realty Corporation. Practitioners who does not want to carry the product may take the option to pay the training cost.

When I say Realty Corporation, it would mean Brokers Association, Appraisers Associations, and Developers Corporations.

The accumulation of a first 180 CPE Credit Hours shall entitle the licensed Real Estate Professional to be inferred with a Masters Degree in Real Estate Service by the University. The second 180 CPE Credit Hours would entitle him to be inferred with a PHD in Real Estate Service.

Lecturer Certification

QUESTION: Sir John, the PRB-RES issued Lecturer Accreditation to some RESPs. What can you say about this?

ANSWER: That kind of certification does not restrict anyone from teaching or lecturing. That is plain cosmetics for the vain ones who want to put so many certificates on their walls, but tolerable. The PRB-RES may issue whatever certification you want as long as you pay for it. Some says issuance of cosmetic certification is how government makes money, but I say that because it is something like an "extra service" (like a blow job in massage spa), that's how some leech-like government officials personally make money (corruption by institutionalized cronyism). Once you participate in getting that thing, you are practically feeding yourself to the leech.

SEC. 11 of the PRC Modernization Act of 2000 says: "Persons to Teach Subjects for Licensure Examination on all Professions. - All subjects for licensure examinations shall be taught by persons who are holders of valid certificates of registration and valid professional licenses of the profession and who comply with the other requirements of the CHED".

So, if there should be any government office who will regulate the education providing in the professional field, it is CHED who does that, not PRC. CHED only regulates the "Professional Teachers".

We also have a principle of academic freedom. All professions (engineers, architects, lawyers, doctors, etc.) are free to impart their knowledge and techniques by teaching in universities, colleges, and conduct seminars and PRC is not supposed to intervene, such as regulate, restrict, the transfer of knowledge and information from one person to another.

QUESTION: I scan the PRC website and was not able to see any information on Lecturer Certification for RES...Where is this info taken?

ANSWER: You won't see blow-job extra service displayed as part of the menu in massage parlors.

Liberalizing the Continuing Professional Education (CPE)


THE FOUR TYPES OF EDUCATION
QUESTION: Rltr. John, how do we rationalize the CPE?
ANSWER: These four types of real estate education are different from each other, (1) CHED Curriculum for BS Real Estate Management, (2) Continuing Professional Education aka CPE, (3) Salesperson Seminar, and (4) Comprehensive Real Estate Seminar and Review in preparation for licensure exam aka CRESR. So, please don't interchange them. The moment you interchange them, you will get confused in policy-making.

The CHED curriculum for BS Real Estate Management should still be developed in close coordination between CHED, PRC, and IPORESP. So in this article, I am only referring to CPE, I am not discussing the CHED Curriculum for BS REM.

CRESR will stay and service providers will still need to be accredited by PRC.

LIBERALIZING THE CPE

One of our Legislative Agenda is to liberalize post-licensing CPE. We want that (1) there is no need for PRC Accreditation for CPE Providers, and (2) CPE will no longer be a requirement in license renewal.

Our principle behind it is that CPE cannot be PRC regulated because PRC can never have sufficient number of staff to monitor all CPE events being attended by over 20,000 licensed real estate service practitioners. If there is no monitoring, it will be an opportunity for fraud. If the CPE is mandatory, then all RESPs will be forced to take it only in PRC-accredited service providers. Because it is too extensive to monitor, the CPE providers will just get seminar fees and issue seminar certificates without the student attending the lectures. The students can get a certificate but will not learn anything. I hate FRAUD. I would never tolerate what's going on to go any further. Fraud must stop.

Knowledge advancement is critical to survive or win a perfectly competitive real estate service market. Each one of us must be given the liberty to choose what to learn and where to learn it from.

Each one of us, as Real Estate Service Practitioners (RESP), allocate a little of our money for advance education to gain more knowledge to gain competitive edge. We don't like a situation wherein we are limited only to attending CPE in the cronies of PRC who have CPE Accreditation certificates. What we want is to have liberty on what topic and where we are getting the learning that we want.

Example, if I want to penetrate the France market, then I will take French Language Lesson, there is no CPE Provider that teaches French language lesson, so I must be given a liberty to take it anywhere.

Second example, as a supervisor of several brokers, I want to take lessons on Management, Supervision, and Leadership. I want to take it in the best school, probably Harvard, Oxford, or anywhere international. Most likely, no CPE Provider who is accredited by PRC is an expert on this field, and I want to spend my budget for CPE to take it somewhere else.

Third example, for my CPE, I want to take an Aircraft Pilot Training Course because I want to develop an expertise in areal real estate photography and teach it. It would be awkward to tell my instructors in the flight school get PRC accreditation so that I can get CPE credits.

It is irrational and impossible that all education providers in the whole world will get PRC accreditation. That is why we want CPE liberalized.

If we will take lessons only from PRC Accredited CPE Provider, it will just be a waste of money because they are repetitively teaching Comprehensive Real Estate Seminar and Review (CRESR) lessons. We are done with CRESR, we don't want to be forced to take it all over and over again.

INTELLECTUAL PROPERTY

Another thing, in a regulated regime, the CPE Provider is required to submit lesson syllabus substance to PRC. We would like to put a stop on this. For me, if I have unique new ideas to teach and I want my intellectual property protected, I would not submit the syllabus to PRC, why would I? However, with regards to syllabus of BS REM curriculum and CRESR, these will still have to be submitted to PRC for approval.

LICENSE TO TEACH

How about the provision that requires PRC Real Estate Professional License to teach? Well, I believe the CPE teachers should not be required. But the teachers of BS REM major subject, teachers of CRESR, and teacher of Salesperson Seminar must be a PRC licensed RE Practitioner in the applicable field.

HARMONIZATION AND MODERNIZATION

Finally, if you look at the PRC Modernization Act of 2000, the CPE is already repealed as requirement for renewal of license in ALL other professions. It is irrational if only the real estate will have CPE.

STRENGTHENING CRESR REGULATION

Nevertheless, if they really want to feed the local seminar providers, the CRESR is the thing that they have to regulate, not the CPE. There should be separate CRESR in preparation for Appraisers and Assessors Licensure, separate CRESR in preparation for Project Developer Licensure Exam, and separate CRESR in preparation for Broker Licensure Exam. They can have PRC Accreditation for CRESR, but NEVER NEVER NEVER regulate the CPE. PRC should be hands off on CPE.

Still, we maintain that starting June 2012, a person needs to be a graduate of a 4 years BS Real Estate Management before he/she can attend any kind of CRESR, and of course before he/she can take the licensure exam. I don't have to elaborate that CRESR should be optional, not mandatory, only for those who want an edge before taking the licensure exam, that is why it is called a "REVIEW". All licensure exam REVIEW CENTERS must be regulated by PRC -- I have no problem with that. Nevertheless, I repeat, never regulate the CPE.

SALESPERSON SEMINAR BELONG TO THE BROKERS

QUESTION: Rltr. John, how about Salesperson Seminar? Should it be regulated?
ANSWER: The RA 9646 IRR can regulate the hours of Salesperson Seminar so that it will be rationalized. Sixteen (16 hours) Salesperson Seminar is sufficient. The Broker is accountable for the obvious mistakes of his/her own Salesperson. To prevent Brokers making excuses that their salesperson commits a mistake because of lack of training, the own Broker of the Salesperson should be the one to provide the Salesperson Seminar (for a fee). Training the subordinate Salesperson is part of the job of a managing/supervising Broker. Recommended reading is Here's a Good Deal for Salespersons.

CPE, is it required? Where to take it?

QUESTION: Rltr. John, is the 60 hours CPE, as specified in the IRR, a requirement for license renewal? For advancement of my knowledge in real estate, where do you advice I take classes?

ANSWER: Actually, we will not renew our license because we are on LICENSING STRIKE. Although that question would be irrelevant under the situation of a STRIKE, I will attempt to enlighten you.

During the time of DTI, our CPE was 16 hours; but a little higher than that, which is 20 hours, will be cast upon you as a penalty if you failed to renew for 3 years.

Without PROPER public consultation, the CPE increased to a TOO EXCESSIVE and TOO OPPRESSIVE point of 60 hours as a result of the lobby of the CPE Providers that we call GARAPATA. From 16, it became 60, coincidentally "sounds" the same.

To attempt to resolve the dispute between 16 and 60, the rational ideal of HARMONIZATION came in. How about in the other professions? Are they required to undergo a CPE to renew their license? If they are required, how many hours is the requirement? Surprisingly, the Sec. 20. of REPUBLIC ACT NO. 8981 THE PRC MODERNIZATION ACT December 2000 has already REPEALED the requiring of CPE in the renewal of license of all professions.

So you see, there is now that guy who said he is VICE PRESIDENT of PhilRES who renewed his license and complained about LAWLESSNESS on why he is not required to present (1) CPE and (2) GOOD STANDING IN PHILRES. Obviously, he is PhilRES and we all know what PhilRES is -- it is the QUEEN'S NEST of the garapatas.

What I want you to do is discern the MOTIVE of his statement. He wants us to respond and rally behind the implementation of those two requirements. Well, we tell him that we are on licensing strike because the CPE is too excessive, among other reasons. Also, the "merely anointed" PHILRES will have to go because it is just a minority that still has not even achieved the minimum membership required to become an AIPO.

The will of the people is to:

(1) REPEAL the CPE,
(2) membership is AIPO is AUTOMATIC and FREE, and
(3) go on LICENSING STRIKE.

By the way, just a bit of advice, do not take that excessive CPE yet, not especially from PAREB, REBAP and any PHILRES allied groups. In short, don't FEED the garapatas because it will incentivise them and will surely suck you even more by force - DELIKADO.

If you want to attend training for self-improvement purposes, there are many CHED-Recognized Shourt-Course and Seminar Providers such as universities that provides lessons on Supervision, Management, Human Resource, Basic Accounting, Internet Marketing, and Leadership. These are the learning that you need. Don't forget to get Official Receipt and Certificate of Attendance specifying hours of learning because these certificates are VALID.

Future prospects of the CPE Providers

QUESTION: Rltr. John, My dad is a CPE Provider (full-time). Me and mu 3 sibblings are in college. What will happen to his livelihood and his fellow CPE Providers when IPORESP becomes AIPORESP? I have heard you will have the CPE provision in the RA 9646 repealed.

ANSWER: At the Legislative level, we will repeal the portion in RA9646 that requires CPE in the license renewal. However, at the IPORESP-level, there will still be a huge department that will administer CPE Providers. Administer, meaning, provide trainor's training, assist in making videocation, etc.

Now I want you to read that post I have earlier about PROFESSIONAL FEES. Ask you Dad about it and he will laugh at you and say "THAT IS SOMETHING NEW, wala yan sa panahon namin". Well, tell you dad the words I will say, "Wala yan sa kanila noon kasi puro kabig pera lang ang inisip nila from the wannabe licensees, hindi nila inisip kung papano mag prosper ang bawat isang licensee".

In IPORESP, our primary objective is to provide opportunities for BUSINESS, SERVICE, and EARNINGS for all licensees. In the new ere, your Dad will have the following options if he wants to continue working as a teacher:

(1) Join a University that offers BS REM and teach the Major Subjects.

(2) Get a IPORESP Trainor's Training on the "IMPLEMENTATION AND AUDIT PROCEDURES FOR PRACTICES THAT CHARGES PROFESSIONAL FEES". This is where the money is. Lahat yang nasa list dyan na Professional Fee Service Menu, meron po yang procedure na auditable na dapat matutunan ng bawat isang Broker na maging active sa serbisyo. When I use the term procedure, I mean step 1, step 2, step 3, step 4 na dapat sundin ng mga Brokers in the execution of the service. Pag merong reclamo matanggap ang IPORESP sa mga transactions with Brokers, ipapa-AUDIT po namin yan sa mga accredited CPE Providers. Mas marami po student ang Dad mo dito kesa sa noon kasi ang PROCEDURES po, lalo na sa PNLS USER PROCEDURE ay magbabago ng mabilis through time casi computerized yan.

(3) Establish an Office that offers the various services. If he wants bigger, he can also establish a Business Associate Scheme (BAS).

(4) Work in the IPORESP HQ (if the IPORESP CEO likes him).

PRODUCE AN INNOVATION AND PATENT IT!

That's the way to do it nowadays. If you are in business or practice of profession, maraming operating cost, mataas ang bayad sa lisensya at nakaka-frustrate ang gobyerno na hindi pinoprotektahan ang lisensyado, may percentage tax ka pa or VAT, ang natira sayo babawasan pa ng 30% income tax, ang natira kapranggot na lang.

Mas maganda innovation, like sulat ka ng educational module or anything that will improve the way we do things, then publish mo and copyright/patent mo. Pag ginamit ng iba, bayad sila. Royalties kikitain mo, 20% tax lang, no questions asked, walang hassle.

WILL THE CPE ABOLITION HAMPER PROFESSIONAL DEVELOPMENT?

Definitely NO. The abolition of the CPE, as a condition of license renewal, will harmonize and level the playing field with other professions who adhere to the PRC Modernization Act of 2000.

When the government removes its heavy hand from the post-licensing education system of the profession, corruption is eradicated and the CPE will actually become LIBERALIZED. With liberalized CPE, the professionals can spend their hard-earned money effectively as they freely exercise their rational choice to take seminars that best fit their needs for self-improvement to excel and survive the stiff competition. With liberalized CPE, we are saying good-bye to those corrupted, useless, repetitive CRESR-like CPEs conducted by the old dogs.

The Garapata Anomaly - be alarmed of your CPE costs

Pag binasa mo yang RESA IRR and mga subsequent Resolutions ng PRB-RES, obvious na obvious mahahalata mo agad na merong "interlocking interest" yang mga naka-upo sa PRB-RES and yang PhilRES. KWARTA from the excessive CPE and SALESPERSON SEMINAR ang motivating factor ng mga garapata. We IPORESP have the numbers kasi tayo ang potential VICTIMS ng mga garapata na yan eh. So, the only solution is to continue the momentum of IPORESP in defeating PhilRES in the APO formation, replace those ill-motivated PRB-RES, and REPEAL the CPE.

TO ALL: PLEASE SHARE this blog and REPOST this everywhere so everyone will be ALARMED.

Be careful kung sino mapag-tanungan nyo kung saan ang daan papuntang AIPO. Pag mga taong garapata matanong nyo, sa PhilRES ka nila ituturo kasi kakwartahan ka ng mga yan. You should be aware before you become a VICTIM. Remember, September 2014 pa ang license renewal ko, in short mas ma-uuna halos kayo lahat maka-feel ng BURDEN na yan. But let's not wait for the time to come that the first RESP to renew license will drown with this high cost. We must all help in the formation of IPORESP, otherwise magiging victim tayo lahat pag hindi tayo magka-isa sa pagtutulungan sa pag-sulong ng advocacy ng IPORESP.

Legal Basis to Repeal CPE

The first time I read Real Estate Service Act of 2009 (RA 9646) in June of 2009, I was struck with the provision on the requirement of Continuing Professional Education (CPE) in license renewal. If I remember it right, while I was still working in Congress, the Sec. 20. of REPUBLIC ACT NO. 8981 THE PRC MODERNIZATION ACT OF 2000 of December 2000 has a Repealing Clause that says "...insofar as it requires completion of the requirements of the Continuing Professional Education (CPE) as a condition for the renewal of the license are hereby REPEALED."

In short, for your info, after the PRC Modernization in 2000, sa lahat na professions, tinanggal na yang CPE as a requirement for renewal of license.

Personally, I have this feeling that the CPE might be a good requirement for renewal of license, but it is so prone to fraud, corruption, abuse, money making, and it is even one of the reasons why AIPO of Real Estate was hijcaked by PhilRES (pangwarta ang motibo). Besides, I don't think PRC is ready to hire at least 50 permanent staff whose only workload is to monitor the conduct of CPE of some over 20,000 RESPs to ensure that there is no fraud. Ako, mahaba ang patience ko, from the beginning alam ko na weak yang hanap-buhay ng PhilRES at mga Associations na kumikita ng pera sa CPE, that is why IPORESP used to try to advocate reduction of CPE costs by 90% para naman mabuhay ang mga CPE providers. Pero pag sumosobra na talaga etong mga CPE providers sa pag sabotahe ng AIPO Formation, talagang mapipilitan tayo to level-up IPORESP advocacy to REPEALING THE CPE as a condition for renewal of license.

In this post, I am just saying that the CPE provision in RA 9646 can be REPEALED and IPORESP MAY POSSIBLY lobby for it. So, for the PhilRES and other CPE-Providers, consider this a gun of IPORESP pointed at you. Huwag nyo akong subukan. Pag hindi kayo mag integrate sa IPORESP talagang ipa-REPEAL ko yang CPE.

Repealing the CPE is the most viable of all the reforms. It can be easily justified. Unfair naman na tayo na nga ang pinaka-impoverished na profession sa dami ng colorum, tapos tayo lang ang profession na papatawan ng CPE requirement in license renewal na napaka-mahal ang gastos. At present, IPORESP is already drafting a letter to Department of Justice (DOJ) to seek assistance in investigating how the PRB-RES came up with excessive CPE hours in Resolution 11, and to seek assistance in repealing the CPE as a requirement for license renewal in harmony with PRC Modernization Act of 2000. A separate letter will also be sent to the Supreme Court to get a restraining order against the Resolution 11 of PRB-RES. With this signal, any person in his right mind will not spend for CPE knowing that its repeal is already in the pipeline.

Where to get Non-Generic CPE

QUESTION: Sir John, where can I have CPE where I can get good value for my money? I hote those generic topics and usual faces in the real estate sector who just brag about their own selves and market their own business the entire day.

ANSWER: Good question. Try visiting your nearest university or college. Universities and Colleges are CHED-Accredited Institutions. They normally have SHORT COURSES and WEEKEND COURSES on various topics. Try also TESDA, they have various topics that can help you earn in any other manner while you wait for your real estate commission jackpot. Don't forget to get Training Certificate that specifies the number of hours.

You can also enrol in UP Open University. You can use the Transcript of Record in UP Open University as proof of CPE.

If you have friends in government, you can also sit-in for FREE in their trainings that involves private sector participation. You have Devt Academy of the Philippines, NEDA, BIR, DENR, LGU, HLURB, PAG-IBIG, etc usually conducting these free trainings to their stakeholders in the private sector. Don't forget to get certificate.

Also, when you attend Accreditation Seminars by Developers, that is a valid CPE. Just get a Seminar Certificate.

Dealing with Brokers Associated with REBAP and PAREB is Discouraged

Selective Lawfulness Anomaly. It appears that the Associations (special mention PAREB and REBAP), who claim to be "law-abiders and licensees", are still conducting CPE and SEMINARS without AIPO CPE Council yet. The public has to be informed NOT TO DEAL with RESPs who are associated with PAREB and REBAP because these people are capable of selecting obedience/disobedience to the Laws and Ethics in Real Estate Service.

Credit Units versus Hours of Training

QUESTION: Sir John, na confuse talaga ako kung ano ang difference ng Credit Unit versus Training Hours. Ano ba distinction?

ANSWER: That is a very intelligent question. In general, for colleges and universities who are operating on a regular two semester academic year, one Credit Unit is equivalent to 16 hours of class contact time.

Ang isang subject sa college ay usually 3 units in one semester, so that is equivalent to 48 hours of class contact time.

If you apply that in developing the IRR of RA 9646, if you say 12 Credit Units of training, that would mean 192 hours of class contact time.

If the PRC adjudicator is unaware of this, it's your lucky day of they would accept 12 Hours training certificate for a required 12 Credit Units.

CPE and Salespersons Training Anomaly

GRABE! Grabe etong report na natanggap ko from a real estate agent! Etong isang Developer nag conduct daw ng seminar for Salespersons, he is one of the PAYING participants. CREBA-member and new Broker daw ang lecturer nila. Turo daw sa kanila eh hindi covered ng RA 9646 ang mga Agents ng Developers kasi may petition pa daw ang CREBA sa supreme court at suportado daw ng "naka-tataas" sa PRC ang petition. Hehehehe yan ang nangyayari pag infiltrated tayo ng mga Anti-RESA from the top and ang CPE ay hindi regulated ng CPE Council na kinabibilangan ng PRC, AIPORESP, CHED.

Ang tawag pa raw nila sa Salesperson Seminar ay CPE at nire-require sila na mag-take ng seminar once a year with that said Broker para patuloy sila makapag-ahente sa Developer na hindi huhulihin ng Broker! Wala naman daw binabanggit na i-register sila ng Broker sa PRC. Ano ba yan! Bakit CPE ang tawag, ehhh ang tawag dapat ay Salespersons Training and once lang yan itini-take ng Salesperson. Parang systematic extortion yata ang na-amoy ko.

Chat QUESTION: Sir John, sabi nyo po ang CPE ay hindi dapat parang CRESR. Ehhh ano po ang dapat na credited as CPE?

ANSWER: The purpose of CPE is for the RESPs to continuously gain "more" and "new" knowledge. When the CPE Council is operational after the institutionalization of AIPORESP, I would probably suggest CPEs should cover units on RE Broker Office Mgt, National Listing User Interface, RE Projects Seminar of various developers, Anomalies in RE Transactions, etc. etc. Dapat CHED-accredited ang CPE Provider para ma-control ang attendance fraud.


Then I will also propose an Online CPE that will be part of the AIPORESP Website. If you are fond of writing an educational module about any topic, you can submit your topic/paper to the CPE Council.

Pag ma-approve ng CPE Council ang topic mo, pwede kang bigyan ng copyright and you will earn per view ng mga RESPs, at tutulungan ka ng AIPORESP na ma-convert yang presentation mo into Interactive Version to be loaded in the AIPORESP Website.

Lahat na RESP makapamili sa dami ng CPE Topics na pagpipilian nila sa AIPORESP Website. Any RESP who is interested on your topic may just pay by credit card to view the online seminar on your topic/s anytime. Everytime they pay, meron kang royalty, kahit patay ka na merong royalty pa rin makukuha mga anak mo.

Ang RESPs naman na mag-view ng Topic mo, kahit saan man siya, ay automatic mabigyan ng hours of credit. Each CPE Topic that the RESP have attencded will be posted in his Professional Profile which can be seen in the AIPORESP Website.

Brokers CPE and Salespersons Trainings

Tingnan mo ang IRR ng RESA, dahil sa gapang ng PHILRES eh naging 120 hours ang required training ng Salespersons. Grabe! Unjust Restriction na, pangwarta pa! Pinipigilan talaga nila na mag-register ang mga salespersons under the brokers, kaya ako nagagalit.

Matagal na yan sila naka-upo, dapat marami na yan natapos ang PRB-RES kung may intention yan sila na i-implement ang RA 9646. QUESTION: Sir John, I heard 7500 daw ang fee right now ng CPE for salesperson? hindi ba masyadong malakii yun? Paano yung mga new na gusto pa lang matoto sa real estate? yung tipong gusto lang magtry ng luck nila? We can't convince anyone to become a salesperson kung ganyan ka mahal.

ANSWER: Ang salespersons hindi CPE ang tawag sa training nila. It is just called Salespersons Training and it is only the Broker who has the most appropriate right and responsibility to train his own salespersons because they are under his control and accountability.

A Salesperson's registration in PRC extinguishes when his contract with his Broker terminates. So when a Salesperson transfer to another Broker, the new Broker has to train the salesperson again. It is the Broker who will endorse the Salesperson for Registration to PRC and his endorsement letter must contain a clause that he is certifying that the Salesperson is already trained by him and ready for operation.

The only part of the training that can probably be contracted out by the Broker to the Training Centers would be Code of Ethics and Responsibilities (wala pa tayo nito) and RA 9646. All the other component of the training of a Salesperson is a responsibility of the Broker.

Training modules for Salespersons vary from one Broker to another, depending on the specialization of the Broker. For example, all Salespersons in my supervision will undergo Exclusive Buyer Agent Training, which is not offered anywhere else. In the other Broker, they might be specialized in Marketing DMCI Projects, so their Salesperson Training should be specialized too and can only be done by them.

I am also not so comfortable in setting a specific number of hours of required training for Salespersons, although I am recommending 16 hours based on what I need to be confident that my EBA Salespersons will be ready for the job. This uncomfort emanates from the fact that each Broker have different specializations, strategies, and area of operation that makes it difficult t o impose s standard on everyone.

QUESTION: Sir John, can I train my own sales person without going to these organizations? As a broker, don't we have the right to train our salespeople by ourselves, since we shall be giving them our license? Why do I have to endorse them to these org who are asking too much?

ANSWER: Regarding your question if you can train your salesperson without passing through the organization or training centers, the answer to that MUST be YES. It will be the CPE Council, by which the IPORESP is a member of it per RA 9646, that will have to present that to be included in the implementing rules and regulations of the RA 9646.

If you look at the IRR of RESA, it only provides IRR to 5% of the law. And these 5% are all unecessary and malicious insertions that seems to appear to be a result of an inappropriate lobby by some selfishly-interested groups.

All these failures we are facing now is a result of a PRB-RES that is not instituted by the Democracy of the IPORESP. It's such a waste of time in implementing the RA 9646. Kaya pag sumasakit na ulo ko, sinasara ko na agad ang topic with a note that PRB-RES must resign para maka-porma na ang Democratic formation ng IPORESP, otherwise mananatili yang ganyan na lalapitan ng mga lobbyists yang nagpapaligaw na PRB-RES.

Sa Brokerage Company ko, my operation is unique, and aware din ako na unique din ang operation ng ibang Brokers. Pag Salesperson ka na galing ka sa ibang Broker at lumipat sa akin, hindi mo kailangan ipagmayabang sa akin yang 120 hours of training na galing sa REBAP or PAREB, hindi ko yan i-consider as the requirement for you to be registered kasi hindi yan ang training na kailangan mo para magawa mo trabaho mo under my supervision, lalo na na ang mga training ng mga grupo na yan ay questionable ang integrity dahil makakakuha ka ng certificate kahit "proxy" lang pinadala mo sa classroom. You have to undergo a new training in my Company before I endorse you for accreditation to PRC.

QUESTION: Sir John, what should be the acceptable date of the last CPE that can be used as a valid for the purpose of registration without exam?

ANSWER: The last CPE date should be 30 July 2009 which is the implementation date of the RA 9646. If you can read Sec 36 of the RA 9646, there can never be a CPE without a CPE Council that is composed partly of representatives from the AIPORESP. There is no AIPORESP yet, so there should be no CPE Council yet, and there should be no CPE yet.

CPE Anomaly

QUESTION: Sir John, I miss your exposition of anomalies. Can you give us another one.

ANSWER: Yes, as you wish, about Continuing Professional Education (CPE). In relation to compliance with the requirements for licensing without exam, the PRC should NOT favorably adjudicate applications with CPE Certificates dated after 30 July 2009 (effectivity of RA 966) until the PRC promulgates CPEs in accordance with the CPE Council (sec 36, RA 9646).

As of today, there is no Accredited and Intergrated Professional Organization (AIPO) yet, so there is no CPE Council yet.

If the PRC approved applications with invalid CPE dates, it is an act of Incompetence that may result to Removal from Office as PRB-RES (sec 9, RA 9646).

Furthermore, all those Organizations, Associations, or DTI-Accredited CEP Providers who have conducted CPE or have issued CPE Certificates after 30 July 2009 (up to the time the PRC accredits CPE) are in violation of the RA 9646 -- their licenses may be jeopardized if they are licensed professionals.

ANSWER: Below are my papers, submitted to PRC 26 Oct 2010 in compliance to the application for license without Exam.

3. Travellers Insurance Surety Bond in favor of PRC and HLURB, 21 Oct 2010

6. Notice of Passing the Exam of 30 Nov 1997

PS: when I they received my application in PRC, the PRC staff verified my paperwork properly. In fact during the verification I saw the staff pulled out my very old DTI file from the index card box. My photo in the index card was 12 years younger -- amazingly baby face pa ako hehehe.

The funny thing is, applicants with anomalous CPE Certificates were approved ahead of me - they are now in the list of those who will attend the oathtaking on 29 November 2010.

I was surprised when I submitted my paperwork, the PRC got my ORIGINAL CPE CERTIFICATE despite presenting a Certifid/Notarized Photocopy. They are not supposed to get it because that is my personal property, I paid for it during the seminar and I will frame it and hang it on my wall. They are getting everyone's original certificate probably with the intention of destroy the evidence later on. The issue is either a lapse in due diligence or a conspiracy.

QUESTION: Sir John, what is your platform about the CPE?

ANSWER: I don't like licensed Brokers to get CPE that is similar to CRESR. I would like the CPE to be contributing to the individual's PROGRESSIVE career in real estate service.

CPEs of Brokers must cover subjects that are required to (1) gain knowledge to pass the exam for Appraisers and (2) gain units credited to master's degree in Real Estate Service. A Broker who passes the Apraisers Exam gets an Appriser's License plus a Master's Degree in Real Estate Service.

CPEs for Appraisers must cover subjects that will help the individual (1) gain knowledge required to pass the exam for Consultants and (2) gain units credited to PhD in Real Estate Service. An Appraiser who passes the Consultant's Exam gets a Consultant's License plus a PhD Degree in Real Estate Service.
