ANSWER: Uyyy maraming tao dyan sa Ayala area and Robinson area. Imposible naman pag hindi ka nakabenta. Yang pamimigay mo ng flier, ang tawag ko dyan ay Cormorant Fishing Anomaly. Pag pasok ng RA 9646, ang mga Developers ay nagulat sa Section and 29 provisions. Sabi pa nga ng CREBA doon sa position nila,

QUESTION: Sir John, gaano ba kabigat yang mga kalaban natin na gusto ma exempt ang Developers sa RESA?

ANSWER: Hehehehe. Mabigat mga dudes. Henry Sy, Lucio Tan, John Gocongwei, Manny Villar, mga Ayala, at iba pang mabibigat na tycoons. Nagulat lang kasi siguro sila na akala nila kinakaladkad sila na magpa-license sa PRC. Ehhhh, hindi dapat sila mag-over-react, sabi ko nga in my opinion, they don't need PRC license to own real estate devt corporations but they have to hire professionals to market, appraise, and build their projects.

Subukan ko personal na bisitahin or padalhan ng advocacy letter etong ating pinaka-mamahal na mga malalaking industrialists. Naniniwala ako na solid ang social responsibility and moral foundation ng mga may-ari ng real estate development corporations na yan eh, at mahalaga sa kanila ang professional standard ng company. Naniniwala ako na ang nag-reresort lang naman ng exploitation sa mga unregistered agents ay yang mga sales managers/directors ng marketing arm nila eh. Makakatulong ng malaki sa professionalization advocacy natin pag mga big boss na ang karamay natin.

In my rational opinion, BYPASS is perfectly legal. BYPASS is not only legal, but in fact it is the IDEAL market scenario. BYPASS is the natural gravity of the market.

The ultimate form of BYPASS is the For Sale by Owner System (FSBO). FSBO is the optimal system of the free-market because it is undisputable that elimination of the middleman makes prices lower. Lower price is good for the seller because it makes the property easier to sell. Lower price is good for the buyer because it makes the property affordable. FSBO is the doomsday that will put the profession of the brokers/agents into extinction.

However, in one little corner of my "heart", I also "feel" that BYPASS could possibly be unfair to the ahente or broker, kaya matagal ko nang gusto ng REFORMS sa real estate system. Nasabi kong unfair dahil unfair naman na nagkikipag kompetensya ang developer sa mga ahente niya sapagkat dapat natin isipin na commission basis ang compensation nyan eh. Mangapital yang ahente ng time, effort, money for two months para maka-reach-out sa buyer, eh ang buyer ay mag-bypass lang. Unfair yang ganyan. Kaya ako NAGAGALIT habang ako ay nakatingin sa grounds from the point of view of an eagle! Ayoko ng exploitation, hindi maka-tao yan.

Ang reporma na nasa isip ko ay ang pag-gawa ng Philippine National Listing System (merong akong separate blog nito, hanapin mo) which will prevent BYPASS with 100% accuracy, without necessarily restricting the right of the Developer to sell his own property. Only a ONE IPORESP can make the Philippine National Listing happen, and this is only possible pag magka-isa tayo lahat na brokers and ahentes na sumunod sa structure ng RA 9646.

Kailangan mo magpa-register kung gusto mo ng trabahong yan. According to RA 9646 of 2009 in PRC and PD957IRR of 2001 in HLURB, kailangan mo maging under ka ng supervision ng isang licensed broker para makapag-register ka sa PRC, para legal ka nang mag-benta ng projects. Anong klaseng Sales Director and Manager ng Developer yang pinasokan mo, ehhh nag-training ka ng mahaba dyan, ehh hindi ka man lang inadvisan na merong HLURB registration requirement, eh kung mahuli ka 4 years prison ang penalty nyan hindi ka tutulungan ng developer na yan. Para lang pinag drive ng public utility bus nyan na wala kang driver license. Dyan pa lang eh dapat napansin mo na na ini-exploit ka.

RA 9646 is designed to stop other people from exploitation your dream success in real estate service. Sa RA 9646 and sa IPORESP, sigurado magiging successful ka kasi FAIR ang policy and system.
