QUESTION: Sir John, is there a way to compel PRB-RES to form the AIPORESP?

ANSWER: Not with this current anomalous PRB-RES. PRB-RES are supposed to be "nominated" by AIPORESP. The PRB-RES will exist only AFTER the accreditation of AIPORESP.

It is the PRC that is mandated by the RA 9646 to form AIPORESP and they have a specific deadline which is within six months (30 July 2009 to 30 Jan 2010). Kaya nga merong mandate to transfer the RESP Records from DTI to PRC. The PRV have no compelling reason not to facilitate the National COnvention because they have the Directory List of all RESPs who should be migrated from DTI to PRC.

Ang problema nagka-mali si PRC, imbis na mag call siya ng National Convention sa mga Charter Members, ehhh nag suggest etong FRESA na sila na lang ang Interim AIPO, so naniwala naman si PRC at nag-imbento siya ng concepto na tinatawag na "Interim AIPO" kahit wala siyang legal basis na gumawa nito. FRESA ang ginawa niyang Interim AIPO, napakarami ang na disenfranchise, and that mistake rolled over into the next perpetual mistakes.

So ngayon, the only solution is this AIPO Formation Initiative na ginagawa mismo natin mga RESPs. When we achieve Formation, our AIPORESP Officers will eventually deal with the PRC.

Since January 2010, I am telling this current anomalous PRB-RES to resign out of delicadeza so PRC can roll back to it's original mandate of facilitatingthe formation of AIPORESP. From there ayun na, naging magulo na, nandun na yung treacherous attempt ng PRB-RES na exempt ang Developers sa RA 9646, dandun na yung disenfranchisement na agrabyado tayo, nandun na yung IRR na puro pangwarta lang para sa mga CPE Providers, nandun na yung extention ng salesperson registration, nandun na yung expansion ng coverage ng reg without exam, nandun na yung exam na wala pang CodER, nandun na yng mga CPE na wala pang CPE Council, ayaw ni ONG kay FRESA (personal reason) so nakipagkontsaba siya sa REBAP na gumawa ng PHILRES, etc etc etc --- what do you expect from an anomalous PRB-RES.

QUESTION: Sir John, what can you say about PRB-RES moving the Salesperson Registration Moratorium to future date after the expiration of July 2011?

ANSWER: The implementation effectivity date of RA 9646 is 30 July 2009. Very specific ang batas on the date. After that date of 20 Jul 2009, BAWAL na ang BAWAL, so dapat STOP ang operation ng lahat na walang license. The 30 Jul 2009 date can only be amended by another Legislation. The PRC have NO POWER to extend such date. Yang ginawa ng PRB-RES, anomalous yan, mali yan, maling-mali, kaya nga treachery ang tawag ko dyan eh.

QUESTION: May legal existence na po ba ang IPORESP o registered na po ba ito sa gobyerno?

ANSWER: Hindi po pwede i-register ang AIPORESP sa SEC pag wala pang na-halal na Trustees and Officers na na-elect ang democracy ng Charter Members. Kailangan di po ng certificate of recognition ng PRC para po ma register ang AIPORESP as the organization that is recognized in line with the implementation of RA 9646.

ANSWER: Tama po kayo. Nasa "Integration" stage pa lang tayo ngayon in compliance with Sec 34 of RA 9646. Ang marching order po ng RA 9646 ay INTEGRATION, hindi po squabble, hindi po pwede "kami-kami" o "sila-sila" o "grupo-grupo", dapat po TAYO LAHAT MAGKA-ISA, at dapat walang ma-disenfranchise kahit isang RESP na carried ng grandfather provision of the RA 9646.

IPORESP is consistently not taking any side between those squabbling factions and I have always persistently been exhorting them to stand down to pave the way for the INTEGRATION. LAHAT po na carried ng grandfather provision (individuals) ay AUTOMATIC member po ng IPORESP, regardless po kung ano man ang association ng tao or kahit po wala association. "ALL" po ito.

As of today, wala pa po AIPORESP at may delicadeza po tayo hindi po tayo lumalapit sa PRB-RES para ma-appoint as AIPO. Nasa integration process pa tayo. After the integration, we will have national convention and election na wala po ma disenfranchize. Then after the election, our officers and trustees will go to PRC to claim the ceremonial mandate of ACCREDITATION. Pag ikaw ay carried ng grandfather provision, ikaw po ay merong boses dito at meron kang karapatan tumakbo sa election or bomoto kung sino ang gusto mo maging officers natin. Our collective voice will shape the AIPORESP. Convenor lang po ako, neutral po ako, wala ako association, at hindi po ako tatakbo ng kahit anong position.
